1. Introduction
Flatbed Connections, LLC ("Flatbed Connections," "Company," "we," "our," or "us") values your privacy and is committed to protecting your personal information. This SMS Communications Privacy Policy explains how we collect, use, share, retain, and protect information obtained from drivers, dispatchers, customers, and other individuals ("you") who consent to receive SMS/text messages from us.


2. Scope of This Policy
This policy applies only to SMS/text message communications. It describes the information we collect in connection with text messaging, how we use and share it, and the choices available to you.

It does not describe how we handle other categories of personal information — such as driver qualification files, employment and payroll records, safety and compliance records, or customer account and billing information. If you have questions about how we handle information outside of text messaging, please contact us using the information in Section 16.


3. SMS Consent
3.1 How We Obtain Consent

We send text messages only to individuals who have affirmatively opted in to receive them. We obtain consent through:

  • Our driver and carrier onboarding documents or verbal approval from driver;

  • A written request you submit to us directly.

We retain a record of each opt-in, including the date, time, and method by which consent was given.

3.2 What Messages You Will Receive

By providing your mobile phone number and consenting to receive SMS messages from Flatbed Connections, LLC, you agree to receive text messages related to business operations, including but not limited to:

  • Load information

  • Dispatch instructions

  • Load status updates

  • Appointment and scheduling updates

  • Operational notifications

  • Account-related communications

Our text messages are transactional and operational only. We do not send marketing or promotional text messages. If we ever wish to send marketing messages, we will obtain your separate prior express written consent before doing so.

3.3 Consent Is Voluntary

Consent to receive SMS messages is not a condition of employment, purchase, or service. If you choose not to receive text messages, or if you later opt out, we will continue to provide the same load, dispatch, and account information by telephone or email, and your working or business relationship with Flatbed Connections will not be affected.

4. Information We Collect
In connection with SMS communications, we may collect:

  • Your name

  • Your mobile phone number

  • Your company affiliation (if applicable)

  • Your carrier or fleet identifier (if applicable)

  • Records of your consent, including the date, time, and method of opt-in

  • Records of any opt-out request, including the date and time

  • Message content, and message delivery and response information (including delivery status, timestamps, and error codes)

We do not request, and you should not send us, Social Security numbers, driver license numbers, financial account numbers, medical information, or other sensitive personal information by text message. See Section 8.3.

5. How We Use Your Information
We use the information described above for the following business purposes:

  • Sending load and dispatch information

  • Providing operational and status updates

  • Communicating service-related and account-related information

  • Responding to your questions and requests

  • Creating and maintaining records of consent and opt-out

  • Detecting, preventing, and investigating fraud, abuse, and security incidents

  • Resolving disputes and enforcing our agreements

  • Complying with our legal, regulatory, and recordkeeping obligations, including those of the Federal Motor Carrier Safety Administration (FMCSA) and the U.S. Department of Transportation (DOT)

We do not use SMS opt-in information for any purpose unrelated to those listed above.


6. How We Share Your Information
6.1 No Sharing for Marketing; No Sale or Rental

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be shared, sold, rented, or transferred to any third parties.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under applicable state privacy laws.

6.2 Service Providers

We share information with service providers only to the extent necessary for them to perform services on our behalf. These providers fall into the following categories:

  • SMS messaging platforms and telecommunications aggregators that transmit our messages

  • Transportation management system (TMS) and dispatch software providers

  • Information technology, hosting, and data backup providers

  • Customer support and administrative support providers

Each of these providers is contractually required to protect your information, to use it only to perform services for us, and not to use it for marketing or for any purpose of their own.

6.3 Affiliates

We do not share mobile information or SMS opt-in data with our affiliates for marketing or promotional purposes. Where we share such information with an affiliate for operational purposes, that affiliate is subject to the same restrictions described in Section 6.2.

6.4 Legal and Regulatory Disclosures

We may disclose information when we reasonably believe disclosure is required or permitted by law — for example, in response to a subpoena, court order, or other lawful request from a government authority or regulator; to comply with FMCSA, DOT, or state transportation requirements; or to establish, exercise, or defend legal claims.

6.5 Business Transfers

If Flatbed Connections is involved in a merger, acquisition, financing, reorganization, or sale of all or part of its assets, information covered by this policy may be transferred as part of that transaction. Any recipient will remain bound by the commitments in this policy with respect to information transferred, or we will provide you notice and an opportunity to opt out before your information becomes subject to a materially different policy.


7. Changes to This Privacy Policy
We retain information for as long as it is needed for the purposes described in this policy, and thereafter as required to meet our legal, regulatory, and recordkeeping obligations or to establish, exercise, or defend legal claims.

In determining how long to retain information, we consider:

  • The duration of your working or business relationship with us;

  • Whether the information is needed to demonstrate that you consented to receive text messages, or that you asked us to stop;

  • Applicable federal and state recordkeeping requirements, including those of the FMCSA and DOT, and the limitations periods that apply to claims under the Telephone Consumer Protection Act (TCPA); and

  • Whether the information is subject to a legal hold, audit, dispute, or regulatory inquiry.

Records of consent and opt-out are retained after the end of our relationship with you so that we can demonstrate compliance with applicable law. When information is no longer needed for any of the purposes described above, we securely delete or de-identify it.

8. Data Security

8.1 Our Safeguards

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, disclosure, alteration, or destruction. These include access controls limiting SMS records to authorized personnel, encryption of data at rest in our systems where practicable, and vendor due diligence.

8.2 No Guarantee

No method of transmission over the internet and no method of electronic storage is completely secure. While we work to protect your information using commercially reasonable measures, we cannot guarantee its absolute security.

8.3 SMS Is Not a Secure Channel

Text messages are not encrypted in transit and can be viewed by anyone with access to your device. Dispatch and load messages may include pickup and delivery locations, appointment times, and shipment details. Please do not send us Social Security numbers, driver license numbers, financial account information, medical information, or other sensitive personal information by text message. Contact us by phone or through our secure channels instead.

9. Opt-Out Rights

You may opt out of SMS communications at any time by:

  • Replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text message from us; or

  • Contacting us using the information in Section 16.

After you send an opt-out keyword, you will receive a single confirmation message and will not receive further SMS messages from Flatbed Connections, LLC unless you provide new consent.

Opting out of text messages does not opt you out of communications by telephone or email, and does not affect your employment, contract, or business relationship with us. You may opt back in at any time by contacting us or by texting START to the number you previously received messages from.

10. Help and Support

For assistance regarding SMS communications:

  • Reply HELP to any text message from us; or

  • Contact Flatbed Connections using the information in Section 16.

11. Message Frequency, Fees, and Delivery

Message frequency. Message frequency varies depending on operational needs and your relationship with Flatbed Connections, LLC. [Drivers and dispatchers typically receive approximately NUMBER to NUMBER messages per week.]

Fees. Message and data rates may apply according to your wireless carrier plan. Flatbed Connections is not responsible for charges imposed by your carrier.

Delivery. Wireless carriers are not liable for delayed or undelivered messages. We cannot guarantee that every message will be delivered, and you should not rely solely on text messages for time-critical or safety-critical information.

12. Changes to Your Mobile Number

If your mobile phone number changes, or if you give up a number that we have on file, please notify us promptly using the information in Section 16 so that we can update our records. This helps prevent our messages from reaching a person who has not consented to receive them.

13. Your Privacy Rights

Depending on where you live, you may have the right to:

  • Request confirmation of whether we process your personal information, and access a copy of it

  • Request correction of inaccurate personal information

  • Request deletion of your personal information

  • Obtain a portable copy of your personal information

  • Opt out of the sale of your personal information or its use for targeted advertising — noting that, as stated in Section 6.1, we do not engage in either

We will not discriminate or retaliate against you for exercising any of these rights.

To submit a request, contact us using the information in Section 16. We will take reasonable steps to verify your identity before responding, and will respond within the time required by applicable law (generally 45 days, with an extension where permitted). If we deny your request, you may appeal by replying to our response or by contacting us at [PRIVACY EMAIL].

Certain information may be exempt from these rights where we are required to retain it under federal or state transportation, safety, employment, or tax law.

14. Children's Privacy

Our services and communications are directed to commercial drivers, dispatchers, and business customers, and are not intended for individuals under the age of 16. We do not knowingly collect personal information from anyone under 16. If you believe a minor has provided us with personal information, contact us and we will delete it.

15. Changes to This Policy

We may update this SMS Communications Privacy Policy periodically. Any modifications will be posted on this page with an updated "Last Updated" date. If we make material changes to how we collect, use, or share information covered by this policy, we will provide additional notice — by text message, email, or a prominent notice on our website — before the changes take effect.
